    Most federal drug trafficking prosecutions begin with 21 U.S.C. § 841. The statute prohibits knowingly or intentionally manufacturing, distributing, dispensing, or possessing a controlled substance with intent to manufacture, distribute, or dispense it without legal authorization.

    Drug Distribution and Possession With Intent

    Federal prosecutors do not have to prove that an actual drug sale took place in every case. A possession with intent to distribute charge can arise when prosecutors claim you knowingly possessed drugs with plans to distribute them, even if no transfer was completed. Giving or transferring drugs to another person can potentially qualify as distribution even without payment.

    These cases may involve fentanyl, methamphetamine, cocaine, heroin, marijuana, or controlled prescription medications. What substance is involved matters, but so does what prosecutors claim you actually did and whether the evidence backs that claim up.

    Importation and Related Charges

    Drug trafficking allegations involving substances brought into the country can result in importation of controlled substances charges. The corresponding federal penalty provisions are found in 21 U.S.C. § 960, which sets different penalty ranges based on the controlled substance, alleged quantity, and other factors.

    Continuing Criminal Enterprise

    A continuing criminal enterprise charge under § 848 has requirements that are significantly different from simply being accused of joining a drug conspiracy. The statute targets a continuing series of qualifying drug violations in which the defendant acts as an organizer, supervisor, or manager of at least five other people and obtains substantial income or resources. A case involving many defendants or alleged transactions does not automatically become a continuing criminal enterprise.

    What Does the Government Have to Prove in a Federal Drug Trafficking Case in Virginia Beach, VA?

    For a typical possession-with-intent charge, the government must prove beyond a reasonable doubt that you knowingly possessed a controlled substance and intended to distribute it.     Drug quantities require separate scrutiny. Under the Guidelines’ relevant-conduct rules, conduct by another participant generally must fall within the scope of the criminal activity you jointly undertook, further that activity, and be reasonably foreseeable to you before it can be attributed to you on that basis. A conspiracy-wide drug total does not simply become each defendant’s personal Guidelines quantity. Statutory mandatory-minimum quantities raise different legal questions and must be analyzed separately.

    Federal Drug Trafficking Penalties

    The federal trafficking penalty provisions create different sentencing ranges for different drug types and quantities. The following table shows common thresholds before qualifying prior-conviction enhancements or other provisions change the range.

    Each figure in the table represents the quantity at which that statutory penalty tier begins. If the alleged quantity reaches the higher threshold, the ordinary penalty range shifts to that higher tier. The listed amounts generally concern the total mixture or substance containing the drug, except where the statute specifically uses actual methamphetamine weight or marijuana plant counts. For methamphetamine, “actual” means the weight of the methamphetamine itself rather than the total weight of the mixture containing it.

    Being under a mandatory-minimum threshold does not make the case a misdemeanor. Many lower-quantity Schedule I or II cases fall under § 841(b)(1)(C), which can carry up to 20 years without a drug-quantity mandatory minimum, before applicable enhancements. Different controlled substances and statutory provisions can carry different ranges. The sentence may also include major financial penalties and years of supervised release after incarceration.

    How Prior Felonies Can Increase Federal Drug Penalties

    For the highest quantity tier under § 841(b)(1)(A), a qualifying serious drug felony or serious violent felony can raise the mandatory minimum from 10 years to 15 years. Multiple qualifying priors can raise the floor even further, potentially to 25 years. For § 841(b)(1)(B), a qualifying conviction can double the minimum from five years to ten and increase the maximum from 40 years to life.

    Not every prior felony qualifies. Under 21 U.S.C. § 851, prosecutors generally have to formally identify the convictions they intend to use for an enhanced sentence before trial or entry of a guilty plea. Your lawyer should examine whether the conviction actually qualifies and whether prosecutors followed the required procedure.

    Death and Serious Bodily Injury Enhancements in Virginia Beach, VA Federal Drug Cases

    Federal drug penalties can become dramatically harsher when the government alleges that use of the distributed substance resulted in death or serious bodily injury, potentially raising the range to 20 years to life. But an overdose alone does not establish the enhancement. The government must prove the legally required connection between the drug and the injury or death.

    An applicable federal mandatory minimum does not disappear just because the judge thinks the sentence is too harsh. Certain exceptions and government motions can sometimes open the door to a sentence below the mandatory minimum.

    Federal Safety-Valve Eligibility

    The federal safety valve can remove the effect of an otherwise applicable mandatory minimum in specified federal drug cases when all eligibility requirements are met. Eligibility depends on all the statutory requirements, including:

    • A criminal record that falls within the statute’s criminal-history limits
    • No qualifying violence, credible threats, or firearm or dangerous-weapon possession connected with the offense, including inducing another participant to engage in that conduct
    • The offense did not result in death or serious bodily injury
    • No disqualifying organizer, leader, manager, or supervisor role, and no continuing criminal enterprise
    • Truthfully disclosing all required information and evidence to the government before the applicable sentencing deadline

    A clean or limited record does not automatically guarantee safety-valve relief in Virginia Beach, VA, and a prior conviction does not automatically rule it out.     Evaluating a Possible Entrapment Defense

    Federal entrapment law focuses on government inducement and whether the defendant was predisposed to commit the crime. An undercover officer offering an opportunity is not enough by itself. The details matter, including the government’s tactics, the amount of persuasion or pressure used, and whether the evidence suggests you were already willing to commit the offense.
