    At the center of many federal drug trafficking prosecutions is 21 U.S.C. § 841. It prohibits unauthorized, knowing or intentional manufacturing, distribution, dispensing, and possession with intent to manufacture, distribute, or dispense a controlled substance.

    Drug Distribution and Possession With Intent

    The government does not always need a completed sale. A possession with intent to distribute charge may be filed when the government alleges that you possessed drugs knowingly and intended for them to reach someone else. Payment is not required for a transfer to count as distribution.

    Federal drug trafficking charges are not limited to any one substance and may involve fentanyl, methamphetamine, cocaine, heroin, marijuana, or controlled prescription medications. Drug type matters for charging and sentencing, but it does not replace the need for evidence tying you to the alleged trafficking.

    Drug Importation and Related Federal Offenses

    If the government alleges that drugs were imported into the United States, prosecutors may bring importation of controlled substances charges. Potential punishment for many of these offenses is addressed by 21 U.S.C. § 960, where penalties can depend on drug type, quantity, and additional facts specified in the statute.

    What Is a Federal Drug Conspiracy Charge in New Orleans, LA?

    Under 21 U.S.C. § 846, a person convicted of attempting or conspiring to commit a federal drug offense faces the same statutory penalties as someone convicted of the underlying offense. That does not mean every defendant receives the same sentence.

    A federal drug conspiracy allegation focuses on whether there was an unlawful agreement and whether you knowingly chose to take part in it. A person can be charged in a drug conspiracy even if officers never recover drugs directly from them. And unlike some other federal conspiracy statutes, § 846 does not require prosecutors to prove a separate overt act, as the Supreme Court held in United States v. Shabani.

    Association is not automatically agreement. You can know someone involved in drug trafficking, live with them, or appear repeatedly in their communications without necessarily joining their alleged conspiracy. We look at what prosecutors say you agreed to do, when you allegedly joined, and what actually supports that account.

    Then there is drug quantity, which can become a fight all by itself. Under the Guidelines’ relevant-conduct rules, another person’s conduct is not simply dumped into your Guidelines calculation. It generally must be within the jointly undertaken activity, in furtherance of it, and reasonably foreseeable to you. The government’s total estimate for the entire conspiracy is not necessarily the quantity that applies to you under the Guidelines. Statutory mandatory-minimum quantities raise different legal questions and must be analyzed separately.

    Federal Drug Trafficking Sentences and Mandatory Minimums

    The sentencing provisions for federal drug trafficking offenses create different sentencing ranges for different drug types and quantities. The table below breaks down several important drug-quantity thresholds before qualifying prior convictions, injury allegations, or other provisions potentially increase the penalties.

    Marijuana 100 kilograms or 100 plants 1,000 kilograms or 1,000 plants

    These are minimum quantities for each tier. Crossing into the higher quantity tier generally moves the case into the corresponding higher statutory range. Most of these quantity thresholds are based on the weight of a mixture or substance containing the drug, while actual methamphetamine and marijuana plant counts are treated differently. When the statute refers to “actual” methamphetamine, it is measuring the methamphetamine itself rather than the entire mixture.

    Falling below these quantity thresholds does not mean the charge is minor. A lower quantity can still expose someone to substantial prison time. Under § 841(b)(1)(C), many Schedule I and II offenses carry up to 20 years even without a quantity-based mandatory minimum, before other enhancements are considered. Other drugs and charging provisions are governed by their own penalty rules. The sentence may also include major financial penalties and years of supervised release after incarceration.

    How Prior Convictions Can Increase the Sentence

    For the highest quantity tier under § 841(b)(1)(A), the ordinary 10-year minimum can jump to 15 years if prosecutors establish a qualifying serious drug felony or serious violent felony. Two or more qualifying priors can push the minimum to 25 years. For § 841(b)(1)(B), a qualifying prior can increase the ordinary 5-to-40-year range to 10 years to life.

    Having a prior felony is not enough by itself to increase the statutory minimum. Under 21 U.S.C. § 851, the government generally must give written notice identifying the prior convictions it plans to rely on before trial or before a guilty plea. Your lawyer should examine whether the conviction actually qualifies and whether prosecutors followed the required procedure.

    Charges Involving Death or Serious Bodily Injury in New Orleans, LA

    An allegation that the distributed drug caused death or serious bodily injury can put a defendant in a 20-years-to-life sentencing range if the government proves the required elements. But an overdose alone does not establish the enhancement. Prosecutors still have to establish the required causal link between the substance involved and the resulting injury or death.

    In Burrage v. United States, the Supreme Court held that the government must prove but-for causation in cases where the controlled substance was not independently sufficient to produce the death. Toxicology findings, polysubstance use, medical evidence, and whether prosecutors can identify the source of the drug may become some of the most important issues in the case.

    Federal Drug Trafficking Charges Involving Firearms in New Orleans, LA

    A firearm connected to alleged drug trafficking can create a separate source of mandatory prison time. Under 18 U.S.C. § 924(c), using or carrying a firearm during and in relation to drug trafficking, or possessing one in furtherance of it, can carry a consecutive mandatory minimum of five years. Brandishing raises that minimum to seven years; discharging raises it to ten. Additional facts involving the firearm can lead to still greater penalties.

    Proximity alone does not necessarily prove that a firearm was possessed in furtherance of drug trafficking. The defense should examine who owned the gun, who could access it, where it was found, what was said about it, and whether the evidence actually ties it to the alleged trafficking.

    Ways a Federal Drug Trafficking Mandatory Minimum May Not Apply

    An applicable federal mandatory minimum does not disappear just because the judge thinks the sentence is too harsh. The key is determining whether one of the recognized legal paths below that minimum applies to your case.

    Qualifying for Safety-Valve Relief

    The federal safety-valve provision can allow qualifying defendants in certain federal drug cases to be sentenced without regard to an otherwise applicable statutory minimum. Safety-valve relief is not automatic. The law requires each of the following conditions to be met:

    • A criminal history within the law’s limits
    • No qualifying use or threat of violence and no disqualifying firearm or dangerous-weapon conduct connected to the offense, including inducing another participant to engage in it
    • No death or serious bodily injury resulting from the offense
    • No disqualifying leadership or management role and no involvement as a principal in a continuing criminal enterprise
    • Truthfully providing the government all required information and evidence by the sentencing deadline

    Being charged with a federal drug offense for the first time in New Orleans, LA does not by itself make you eligible, just as having a prior conviction does not necessarily end the inquiry. The number prosecutors put on the table is only the starting point; the defense still needs to test what supports it.

    How Federal Drug Trafficking Charges Can Be Defended in New Orleans, LA

    In some cases, the central fight is whether you knowingly took part in the alleged trafficking. In others, the battle is over whether the government’s evidence was lawfully obtained in the first place. There is no useful one-size-fits-all defense. The evidence should dictate where the pressure gets applied.

For methamphetamine, the distinction between actual drug weight and mixture weight can change which statutory threshold applies. In a conspiracy case, a reliable laboratory result still does not resolve which transactions are legally attributable to a particular defendant.

    Drug identity, possession, knowledge, and intent are different issues. Showing what was inside a package does not automatically prove you knew about it or joined a plan to distribute it.

    Evaluating Entrapment Where the Evidence Supports It

    Federal entrapment law focuses on government inducement and whether the defendant was predisposed to commit the alleged offense. Simply giving someone the opportunity to commit a crime does not, by itself, establish entrapment. The details matter, including the government’s tactics, the amount of persuasion or pressure used, and whether the evidence suggests you were already willing to commit the offense.
