    Most federal drug trafficking prosecutions begin with 21 U.S.C. § 841. The statute prohibits knowingly or intentionally manufacturing, distributing, dispensing, or possessing a controlled substance with intent to manufacture, distribute, or dispense it without legal authorization.

    Drug Distribution and Possession With Intent

    The government does not always need a completed sale. A possession with intent to distribute charge may be based on evidence that you knowingly possessed a controlled substance and intended to distribute it to another person. Giving or transferring drugs to another person can potentially qualify as distribution even without payment.

    The controlled substance at issue might be fentanyl, methamphetamine, cocaine, heroin, marijuana, or a prescription medication regulated under federal law. Drug type matters for charging and sentencing, but it does not replace the need for evidence tying you to the alleged trafficking.

    When Federal Drug Charges Involve Importation

    Allegations that drugs entered the United States can lead to importation of controlled substances charges. Potential punishment for many of these offenses is addressed by 21 U.S.C. § 960, with punishment tied to the substance, quantity, and other statutory factors.

    Continuing Criminal Enterprise Under Federal Drug Law

    A continuing criminal enterprise charge under § 848 has requirements that are significantly different from simply being accused of joining a drug conspiracy. Under the Guidelines’ relevant-conduct rules, another participant’s acts must fall within the criminal activity you jointly undertook, further that activity, and be reasonably foreseeable to you before they count on that basis. The government’s total estimate for the entire conspiracy is not necessarily the quantity that applies to you under the Guidelines. And when a particular quantity is being used to trigger a statutory minimum sentence, the analysis does not stop with the Guidelines.

    Federal Drug Trafficking Penalties

    The federal drug trafficking penalty provisions set different statutory ranges depending largely on the controlled substance and the amount attributed to the offense. The following table shows common thresholds before qualifying prior-conviction enhancements or other provisions change the range.

    The amounts above mark the minimum quantities for the listed penalty tiers. If the alleged quantity reaches the higher threshold, the ordinary penalty range shifts to that higher tier. The listed amounts generally concern the total mixture or substance containing the drug, except where the statute specifically uses actual methamphetamine weight or marijuana plant counts. The term “actual” methamphetamine refers specifically to the amount of methamphetamine itself, not the full weight of the surrounding mixture.

    Falling below these quantity thresholds does not mean the charge is minor. Even when the alleged quantity does not trigger the five- or ten-year minimum, many Schedule I or II offenses under § 841(b)(1)(C) can still carry as much as 20 years in prison before applicable enhancements. The exact limits can differ for other substances and other subsections of federal law. Federal drug convictions can carry significant fines as well as supervised release after any prison term.

    How Prior Convictions Can Increase the Sentence

    For the highest quantity tier under § 841(b)(1)(A), one qualifying prior serious drug felony or serious violent felony can add another five years to the statutory minimum, taking it from 10 years to 15. Two or more can raise it to 25 years. For § 841(b)(1)(B), one qualifying prior can change the usual range from 5 to 40 years into 10 years to life.

    Not every prior felony qualifies. Under 21 U.S.C. § 851, the prosecution generally cannot spring the enhancement on you at sentencing; it must file written notice identifying the qualifying conviction before trial or a guilty plea. The conviction’s legal qualifications and the government’s compliance with that process both matter.

    Federal Drug Charges Involving Death or Serious Bodily Injury in Minneapolis, MN

    Federal drug penalties can become dramatically harsher when the government alleges that use of the distributed substance resulted in death or serious bodily injury, potentially raising the range to 20 years to life.     • A criminal record that falls within the statute’s criminal-history limits
    • No qualifying use or threat of violence and no disqualifying firearm or dangerous-weapon conduct connected to the offense, including inducing another participant to engage in it
    • The offense did not result in death or serious bodily injury
    • No qualifying organizer, leader, manager, or supervisor role, and no continuing criminal enterprise offense
    • Truthfully disclosing all required information and evidence to the government before the applicable sentencing deadline
