    The central federal trafficking statute is 21 U.S.C. § 841. It reaches several forms of drug trafficking conduct, including manufacturing, distribution, dispensing, and possession with intent to distribute controlled substances.

    Possession With Intent to Distribute and Other Federal Drug Charges

    Federal prosecutors do not have to prove that an actual drug sale took place in every case. A possession with intent to distribute charge can arise when prosecutors claim you knowingly possessed drugs with plans to distribute them, even if no transfer was completed. A transfer can qualify as distribution even when no money changes hands.

    The controlled substance at issue might be fentanyl, methamphetamine, cocaine, heroin, marijuana, or a prescription medication regulated under federal law. The drug’s identity matters, but so do the specific conduct charged and the evidence connecting that conduct to you.

    Drug Importation and Related Federal Offenses

    Drug trafficking allegations involving substances brought into the country can result in importation of controlled substances charges. Under the Guidelines’ relevant-conduct rules, the conduct of co-conspirators does not automatically become your conduct for sentencing. The acts generally must fit within the scope of what you jointly undertook, further that activity, and have been reasonably foreseeable to you. A conspiracy-wide drug total does not simply become each defendant’s personal Guidelines quantity. The quantity controlling a statutory minimum requires its own legal analysis.

    Federal Drug Trafficking Penalties

    The federal drug trafficking penalty provisions can change the sentencing range dramatically depending on what drug is involved and how much prosecutors say was involved. The table below breaks down several important drug-quantity thresholds before qualifying prior convictions, injury allegations, or other provisions potentially increase the penalties.

    These thresholds show where the listed statutory sentencing ranges begin to apply. Once the higher threshold applies, its ordinary range replaces the lower tier. With the exceptions of actual methamphetamine and marijuana plant counts, these thresholds generally refer to the weight of a mixture or substance containing the controlled drug. The term “actual” methamphetamine refers specifically to the amount of methamphetamine itself, not the full weight of the surrounding mixture.

    Below-threshold does not mean misdemeanor. Even when the alleged quantity does not trigger the five- or ten-year minimum, many Schedule I or II offenses under § 841(b)(1)(C) can still carry as much as 20 years in prison before applicable enhancements. Other substances and provisions have different limits. Federal drug convictions can carry significant fines as well as supervised release after any prison term.

    When a Prior Conviction Can Increase a Federal Drug Sentence

    For the highest quantity tier under § 841(b)(1)(A), one qualifying serious drug felony or serious violent felony can increase the minimum from 10 to 15 years. With two or more qualifying convictions, the mandatory minimum can climb to 25 years. For § 841(b)(1)(B), a qualifying conviction can double the minimum from five years to ten and increase the maximum from 40 years to life.

    Having a prior felony is not enough by itself to increase the statutory minimum. Under 21 U.S.C. § 851, prosecutors generally must file written notice identifying the convictions before trial or a guilty plea to seek the increased punishment. Your lawyer should examine whether the conviction actually qualifies and whether prosecutors followed the required procedure.

    Death and Serious Bodily Injury Enhancements in Birmingham, AL Federal Drug Cases

    Safety-Valve Eligibility

    The federal safety-valve provision can allow qualifying defendants in certain federal drug cases to be sentenced without regard to an otherwise applicable statutory minimum. To qualify, the defendant must satisfy every statutory condition, including:

    • A criminal record that falls within the statute’s criminal-history limits
    • No qualifying violence, credible threats, or disqualifying firearm or dangerous-weapon involvement tied to the offense
    • No death or serious bodily injury resulting from the offense
    • No qualifying organizer, leader, manager, or supervisor role, and no continuing criminal enterprise offense
    • Truthfully providing the government all required information and evidence by the sentencing deadline

    Being charged with a federal drug offense for the first time in Birmingham, AL does not by itself make you eligible, just as having a prior conviction does not necessarily end the inquiry.
