    The central federal trafficking statute is 21 U.S.C. § 841. Under this law, prosecutors can pursue charges involving unauthorized manufacturing or distribution of controlled substances, as well as possession with intent to distribute.

    Federal Distribution, Manufacturing, and Possession With Intent Charges

    A completed drug deal is not necessary for prosecutors to bring certain federal trafficking charges. A possession with intent to distribute charge may be based on evidence that you knowingly possessed a controlled substance and intended to distribute it to another person. Payment is not required for a transfer to count as distribution.

    Federal trafficking prosecutions can involve substances ranging from fentanyl and methamphetamine to cocaine, heroin, marijuana, and controlled prescription drugs. What substance is involved matters, but so does what prosecutors claim you actually did and whether the evidence backs that claim up.

    Drug Importation and Related Federal Offenses

    When prosecutors claim controlled substances were brought into the United States, the case may include importation of controlled substances charges. The corresponding federal penalty provisions are found in 21 U.S.C. § 960, with sentencing exposure determined in part by the substance involved, its quantity, and other statutory circumstances.

    When Prosecutors Allege a Continuing Criminal Enterprise

    A continuing criminal enterprise charge under § 848 goes beyond an allegation that you merely participated in a drug conspiracy. Among other requirements, the government must prove a continuing series of qualifying drug violations, that the accused occupied an organizing, supervisory, or managerial role over at least five people, and that the enterprise produced substantial income or resources. Simply appearing in a sprawling federal indictment does not prove the elements of a continuing criminal enterprise.

    What Must Federal Prosecutors Prove in a Drug Trafficking Case in Fresno, CA?

    In a typical possession-with-intent case, prosecutors must establish beyond a reasonable doubt both knowing possession of a controlled substance and an intent to distribute it. The model federal jury instruction for possession with intent to distribute lays out these basic elements.

    Drug quantity creates another layer of questions. Under the Guidelines’ relevant-conduct rules, another participant’s acts must fall within the criminal activity you jointly undertook, further that activity, and be reasonably foreseeable to you before they count on that basis. The entire conspiracy’s drug quantity is not automatically your Guidelines quantity. Statutory mandatory-minimum quantities raise different legal questions and must be analyzed separately.

    What Are the Penalties for Federal Drug Trafficking?

    The sentencing provisions for federal drug trafficking offenses can change the sentencing range dramatically depending on what drug is involved and how much prosecutors say was involved. The following table shows common thresholds before qualifying prior-conviction enhancements or other provisions change the range.

    These are minimum quantities for each tier. If the alleged quantity reaches the higher threshold, the ordinary penalty range shifts to that higher tier. Most of these quantity thresholds are based on the weight of a mixture or substance containing the drug, while actual methamphetamine and marijuana plant counts are treated differently. When the statute refers to “actual” methamphetamine, it is measuring the methamphetamine itself rather than the entire mixture.

    Below-threshold does not mean misdemeanor. Even when the alleged quantity does not trigger the five- or ten-year minimum, many Schedule I or II offenses under § 841(b)(1)(C) can still carry as much as 20 years in prison before applicable enhancements. Other substances and provisions have different limits. Federal drug convictions can carry significant fines as well as supervised release after any prison term.

    How Prior Convictions Can Increase the Sentence

    For the highest quantity tier under § 841(b)(1)(A), the ordinary 10-year minimum can jump to 15 years if prosecutors establish a qualifying serious drug felony or serious violent felony. With two or more qualifying convictions, the mandatory minimum can climb to 25 years. For § 841(b)(1)(B), a qualifying prior can increase the ordinary 5-to-40-year range to 10 years to life.

    A felony on your record does not automatically trigger these enhanced penalties. Under 21 U.S.C. § 851, prosecutors generally have to formally identify the convictions they intend to use for an enhanced sentence before trial or entry of a guilty plea. That makes both the prior conviction itself and the government’s compliance with the notice requirements important defense issues.

    Charges Involving Death or Serious Bodily Injury in Fresno, CA

    Federal drug penalties can become dramatically harsher when the government alleges that use of the distributed substance resulted in death or serious bodily injury, potentially raising the range to 20 years to life. The fact that someone overdosed does not, standing alone, prove the sentencing enhancement. The government must prove the legally required connection between the drug and the injury or death.

    In Burrage v. United States, the Supreme Court made clear that, when the drug was not independently enough to cause death, prosecutors must satisfy a but-for causation standard. Toxicology, other substances, medical evidence, and identification of the source can become central defense issues.

If the firearm is brandished, the minimum rises to seven years, while discharging it raises the minimum to ten. Additional facts involving the firearm can lead to still greater penalties.

    An applicable federal mandatory minimum does not disappear just because the judge thinks the sentence is too harsh. Certain exceptions and government motions can sometimes open the door to a sentence below the mandatory minimum.

    Can the Federal Safety Valve Apply?

    The federal safety valve allows qualifying defendants convicted of specified drug offenses to be sentenced without the otherwise applicable minimum. Eligibility depends on all the statutory requirements, including:

    • A criminal history within the law’s limits
    • No qualifying use or threat of violence and no disqualifying firearm or dangerous-weapon conduct connected to the offense, including inducing another participant to engage in it
    • No death or serious bodily injury caused by the offense
    • No qualifying organizer, leader, manager, or supervisor role, and no continuing criminal enterprise offense
    • Truthfully disclosing all required information and evidence to the government before the applicable sentencing deadline

    Being a first-time drug defendant in Fresno, CA does not automatically establish eligibility, and having a prior conviction does not answer the question by itself.     Defenses to Federal Drug Trafficking Charges in Fresno, CA

    Entrapment requires government inducement and a lack of predisposition to commit the alleged offense. An undercover officer offering an opportunity is not enough by itself. The details matter, including the government’s tactics, the amount of persuasion or pressure used, and whether the evidence suggests you were already willing to commit the offense.
