    One of the primary laws used in federal drug trafficking cases is 21 U.S.C. § 841. It prohibits unauthorized, knowing or intentional manufacturing, distribution, dispensing, and possession with intent to manufacture, distribute, or dispense a controlled substance.

    Distribution, Manufacturing, and Possession With Intent

    A completed drug deal is not necessary for prosecutors to bring certain federal trafficking charges. A possession with intent to distribute charge can rest on an allegation that you knowingly possessed drugs and intended to transfer them to someone else. Distribution does not necessarily require payment or a traditional sale.

    Federal trafficking prosecutions can involve substances ranging from fentanyl and methamphetamine to cocaine, heroin, marijuana, and controlled prescription drugs. The drug’s identity matters, but so do the specific conduct charged and the evidence connecting that conduct to you.

    When Federal Drug Charges Involve Importation

    If the government alleges that drugs were imported into the United States, prosecutors may bring importation of controlled substances charges. Federal sentencing provisions for these charges appear in 21 U.S.C. § 960, where penalties can depend on drug type, quantity, and additional facts specified in the statute.

The government’s total estimate for the entire conspiracy is not necessarily the quantity that applies to you under the Guidelines. The quantity controlling a statutory minimum requires its own legal analysis.

    What Are the Penalties for Federal Drug Trafficking?

    The federal trafficking penalty provisions create different sentencing ranges for different drug types and quantities. The table below breaks down several important drug-quantity thresholds before qualifying prior convictions, injury allegations, or other provisions potentially increase the penalties.

    These thresholds show where the listed statutory sentencing ranges begin to apply. When the higher quantity threshold is met, the higher statutory range generally applies instead of the lower one. Except for actual methamphetamine and plant counts, the table generally uses the weight of a mixture or substance containing the listed drug. The term “actual” methamphetamine refers specifically to the amount of methamphetamine itself, not the full weight of the surrounding mixture.

    Falling below these quantity thresholds does not mean the charge is minor. Many lower-quantity Schedule I or II cases fall under § 841(b)(1)(C), which can carry up to 20 years without a drug-quantity mandatory minimum, before applicable enhancements. The exact limits can differ for other substances and other subsections of federal law. The sentence may also include major financial penalties and years of supervised release after incarceration.

    How Prior Felonies Can Increase Federal Drug Penalties

    For the highest quantity tier under § 841(b)(1)(A), one qualifying serious drug felony or serious violent felony can increase the minimum from 10 to 15 years. Two or more qualifying priors can push the minimum to 25 years. For § 841(b)(1)(B), one qualifying prior can change the usual range from 5 to 40 years into 10 years to life.

    Having a prior felony is not enough by itself to increase the statutory minimum. Under 21 U.S.C. § 851, prosecutors generally must file written notice identifying the convictions before trial or a guilty plea to seek the increased punishment. There are two questions to examine closely: does the prior legally qualify, and did the government follow the process required to use it?

    When Federal Drug Trafficking Is Alleged to Cause Death or Serious Injury in Jersey City, NJ

    If prosecutors can prove that death or serious bodily injury resulted from use of the drug involved in the offense, the statutory range can increase to 20 years to life. The fact that someone overdosed does not, standing alone, prove the sentencing enhancement. The government must connect the drug involved in the case to the death or serious injury under the applicable causation standard.

    In Burrage v. United States, the Supreme Court held that but-for causation is required for the death-results enhancement when the drug itself was not independently sufficient to cause death.     The federal drug sentencing safety valve can allow qualifying defendants in certain federal drug cases to be sentenced without regard to an otherwise applicable statutory minimum. To qualify, the defendant must satisfy every statutory condition, including:

    • A criminal record that falls within the statute’s criminal-history limits
    • No qualifying use or threat of violence and no disqualifying firearm or dangerous-weapon conduct connected to the offense, including inducing another participant to engage in it
    • The offense did not result in death or serious bodily injury
    • No disqualifying organizer, leader, manager, or supervisor role, and no continuing criminal enterprise
    • Truthfully providing the government all required information and evidence by the sentencing deadline

    Safety-valve eligibility in Jersey City, NJ cannot be reduced to a simple first-offense-versus-prior-record question.
