    The central federal trafficking statute is 21 U.S.C. § 841. It reaches several forms of drug trafficking conduct, including manufacturing, distribution, dispensing, and possession with intent to distribute controlled substances.

    Possession With Intent to Distribute and Other Federal Drug Charges

    Money changing hands is not required for every federal trafficking charge. A possession with intent to distribute charge can arise when prosecutors claim you knowingly possessed drugs with plans to distribute them, even if no transfer was completed. A transfer can qualify as distribution even when no money changes hands.

    Federal trafficking prosecutions can involve substances ranging from fentanyl and methamphetamine to cocaine, heroin, marijuana, and controlled prescription drugs. The drug’s identity matters, but so do the specific conduct charged and the evidence connecting that conduct to you.

    Drug Importation and Related Federal Offenses

    Allegations that drugs entered the United States can lead to importation of controlled substances charges. Federal sentencing provisions for these charges appear in 21 U.S.C. § 960, where penalties can depend on drug type, quantity, and additional facts specified in the statute.

    When Prosecutors Allege a Continuing Criminal Enterprise

The government’s total estimate for the entire conspiracy is not necessarily the quantity that applies to you under the Guidelines. A drug quantity that triggers a statutory mandatory minimum involves a separate legal analysis.

    Penalties for Federal Drug Trafficking

    The federal drug trafficking penalty provisions set different statutory ranges depending largely on the controlled substance and the amount attributed to the offense. The table below breaks down several important drug-quantity thresholds before qualifying prior convictions, injury allegations, or other provisions potentially increase the penalties.

    Each figure in the table represents the quantity at which that statutory penalty tier begins. Crossing into the higher quantity tier generally moves the case into the corresponding higher statutory range. The listed amounts generally concern the total mixture or substance containing the drug, except where the statute specifically uses actual methamphetamine weight or marijuana plant counts. When the statute refers to “actual” methamphetamine, it is measuring the methamphetamine itself rather than the entire mixture.

    Do not mistake “below the threshold” for “not serious.” Even when the alleged quantity does not trigger the five- or ten-year minimum, many Schedule I or II offenses under § 841(b)(1)(C) can still carry as much as 20 years in prison before applicable enhancements. Other substances and provisions have different limits. Prison is also not the only consequence; substantial fines and terms of supervised release may follow a conviction.

    How Prior Felonies Can Increase Federal Drug Penalties

    For the highest quantity tier under § 841(b)(1)(A), the ordinary 10-year minimum can jump to 15 years if prosecutors establish a qualifying serious drug felony or serious violent felony. Two or more qualifying priors can push the minimum to 25 years. For § 841(b)(1)(B), the ordinary 5-to-40-year sentencing range can become 10 years to life when a qualifying prior applies.

    The government cannot treat just any prior conviction as a qualifying enhancement. Under 21 U.S.C. § 851, the government generally must give written notice identifying the prior convictions it plans to rely on before trial or before a guilty plea. The conviction’s legal qualifications and the government’s compliance with that process both matter.

    Charges Involving Death or Serious Bodily Injury in Madison, WI

    If prosecutors can prove that death or serious bodily injury resulted from use of the drug involved in the offense, the statutory range can increase to 20 years to life. An overdose by itself does not automatically trigger that punishment. Prosecutors still have to establish the required causal link between the substance involved and the resulting injury or death.

    The federal drug sentencing safety valve can allow qualifying defendants in certain federal drug cases to be sentenced without regard to an otherwise applicable statutory minimum. To qualify, the defendant must satisfy every statutory condition, including:

    • Criminal history that does not exceed the limits set by the safety-valve statute
    • No qualifying violence, credible threats, or disqualifying firearm or dangerous-weapon involvement tied to the offense
    • No death or serious bodily injury resulting from the offense
    • No disqualifying organizer, leader, manager, or supervisor role, and no continuing criminal enterprise
    • Providing the government, truthfully and on time, all information and evidence required by the statute

    Being a first-time drug defendant in Madison, WI does not automatically establish eligibility, and having a prior conviction does not answer the question by itself.
