    Federal Drug Trafficking Laws and Charges

    At the center of many federal drug trafficking prosecutions is 21 U.S.C. § 841. The statute prohibits knowingly or intentionally manufacturing, distributing, dispensing, or possessing a controlled substance with intent to manufacture, distribute, or dispense it without legal authorization.

    Federal Distribution, Manufacturing, and Possession With Intent Charges

    A completed drug deal is not necessary for prosecutors to bring certain federal trafficking charges. A possession with intent to distribute charge can arise when prosecutors claim you knowingly possessed drugs with plans to distribute them, even if no transfer was completed. Payment is not required for a transfer to count as distribution.

    The controlled substance at issue might be fentanyl, methamphetamine, cocaine, heroin, marijuana, or a prescription medication regulated under federal law. The drug’s identity matters, but so do the specific conduct charged and the evidence connecting that conduct to you.

    When Federal Drug Charges Involve Importation

    Allegations that drugs entered the United States can lead to importation of controlled substances charges. Related penalties appear in 21 U.S.C. § 960, which sets different penalty ranges based on the controlled substance, alleged quantity, and other factors.

    Continuing Criminal Enterprise

    A continuing criminal enterprise charge under § 848 has requirements that are significantly different from simply being accused of joining a drug conspiracy. Among other requirements, the government must prove a continuing series of qualifying drug violations, that the accused occupied an organizing, supervisory, or managerial role over at least five people, and that the enterprise produced substantial income or resources. The size of the government’s case is not a substitute for proving each requirement of § 848.

    What Does the Government Have to Prove in a Federal Drug Trafficking Case in Wichita, KS?

    In a typical possession-with-intent case, prosecutors must establish beyond a reasonable doubt both knowing possession of a controlled substance and an intent to distribute it.     Under 21 U.S.C. § 846, the statutory penalty for a federal drug conspiracy can be the same as the penalty for the drug offense prosecutors claim the conspirators agreed to commit. That does not mean everyone named in the conspiracy will necessarily receive the same sentence.

    The amount of drugs attributed to you deserves its own careful analysis. Under the Guidelines’ relevant-conduct rules, another participant’s acts must fall within the criminal activity you jointly undertook, further that activity, and be reasonably foreseeable to you before they count on that basis. A conspiracy-wide drug total does not simply become each defendant’s personal Guidelines quantity. And when a particular quantity is being used to trigger a statutory minimum sentence, the analysis does not stop with the Guidelines.

    Federal Drug Trafficking Penalties

    The federal trafficking penalty provisions create different sentencing ranges for different drug types and quantities. These common thresholds illustrate when the ordinary five-year and ten-year mandatory minimum tiers can come into play, before other enhancements are considered.

    These thresholds show where the listed statutory sentencing ranges begin to apply. Once the higher threshold applies, its ordinary range replaces the lower tier. With the exceptions of actual methamphetamine and marijuana plant counts, these thresholds generally refer to the weight of a mixture or substance containing the controlled drug. The term “actual” methamphetamine refers specifically to the amount of methamphetamine itself, not the full weight of the surrounding mixture.

    Below-threshold does not mean misdemeanor. Many lower-quantity Schedule I or II cases fall under § 841(b)(1)(C), which can carry up to 20 years without a drug-quantity mandatory minimum, before applicable enhancements. Other drugs and charging provisions are governed by their own penalty rules. The sentence may also include major financial penalties and years of supervised release after incarceration.

    How Criminal History Can Increase Federal Drug Trafficking Penalties

    For the highest quantity tier under § 841(b)(1)(A), a qualifying serious drug felony or serious violent felony can raise the mandatory minimum from 10 years to 15 years. Multiple qualifying priors can raise the floor even further, potentially to 25 years. For § 841(b)(1)(B), a qualifying prior can increase the ordinary 5-to-40-year range to 10 years to life.

    The government cannot treat just any prior conviction as a qualifying enhancement. Under 21 U.S.C. § 851, prosecutors generally have to formally identify the convictions they intend to use for an enhanced sentence before trial or entry of a guilty plea. Your lawyer should examine whether the conviction actually qualifies and whether prosecutors followed the required procedure.

    When Federal Drug Trafficking Is Alleged to Cause Death or Serious Injury in Wichita, KS

    If prosecutors can prove that death or serious bodily injury resulted from use of the drug involved in the offense, the statutory range can increase to 20 years to life. That does not mean every overdose connected to an investigation automatically supports the enhancement. There still has to be legally sufficient proof tying the distributed drug to the death or serious bodily injury.

    In Burrage v. United States, the Supreme Court held that but-for causation is required for the death-results enhancement when the drug itself was not independently sufficient to cause death.     Is It Possible to Get Below a Federal Drug Trafficking Mandatory Minimum?

    Once a mandatory minimum legally applies, a judge usually cannot sidestep it based only on fairness or sympathy. There are, however, limited legal mechanisms that can authorize a sentence below the statutory floor.

    Federal Safety-Valve Eligibility

    The federal safety-valve provision can remove the effect of an otherwise applicable mandatory minimum in specified federal drug cases when all eligibility requirements are met. Safety-valve relief is not automatic. The law requires each of the following conditions to be met:

    • Criminal history that does not exceed the limits set by the safety-valve statute
    • No qualifying violence, credible threats, or firearm or dangerous-weapon possession connected with the offense, including inducing another participant to engage in that conduct
    • No death or serious bodily injury caused by the offense
    • No disqualifying organizer, leader, manager, or supervisor role, and no continuing criminal enterprise
    • Truthfully providing the government all required information and evidence by the sentencing deadline

    Being charged with a federal drug offense for the first time in Wichita, KS does not by itself make you eligible, just as having a prior conviction does not necessarily end the inquiry.     How Federal Drug Trafficking Charges Can Be Defended in Wichita, KS

    One federal drug case may come down to whether prosecutors can prove knowing participation, while another may hinge on whether crucial evidence should ever reach a jury. A defense should follow the evidence in your case, not a standard list of motions.

    Entrapment requires government inducement and a lack of predisposition to commit the crime. Simply giving someone the opportunity to commit a crime does not, by itself, establish entrapment. The details matter, including the government’s tactics, the amount of persuasion or pressure used, and whether the evidence suggests you were already willing to commit the offense.

    Being indicted does not mean the government has proven the case. A grand jury’s probable-cause determination is different from the proof beyond a reasonable doubt required to convict at trial.
