Scott Michael Dunn: What happens to my CDL if I get a DUI in Illinois?

Joshua Boardman: Well, if you are a CDL holder, several things inherently are affected by charge for a DUI. For one, the BAC threshold is lower. So if you’re a CDL holder, the BAC that needs to be demonstrated is anything above .04 instead of .08. Also with CDL holders, the state government and the federal government hold those drivers to higher standards. So that affects what sort of penalties or sentences can be imposed against you later on in the case. They’re called anti-masking statutes or anti-masking laws. And under those laws, you are limited in what sentences can be imposed. That, for example, with a federal masking statute requires that prosecuting attorneys, state’s attorneys, judges do not defer imposition of a sentence or do not try to mirror or mask a conviction in those cases. So we tell CDL holders, I mean you can expect that outside of an acquittal, or a dismissal, or something like that, there is a good chance that your CDL privileges will be impacted.
