Scott Michael Dunn: What if the Illinois officer didn’t read me my Miranda rights?
Joshua Boardman: Everyone thinks they are able to beat a case because of either the timing of the reading of the Miranda rights or they claim that the Miranda rights were not read. But whenever we get a case, we immediately search for potential suppression issues based on the Fourth Amendment of the Constitution, search and seizure laws. So, yes, we’ll see whenever the defendant was in custody and being placed under arrest, when were those Miranda rights read? More often than not, law enforcement does operate in accordance with the state and federal law on those topics. But, we analyze every single case that comes through the door for Fourth Amendment applicability.
