Interview Transcript

Scott Michael Dunn: Do sex crimes carry mandatory prison time in Illinois?

Joshua Boardman: Yes, they can. The higher level ones can certainly, once they reach those class ones, Class X’s, they are no longer probation eligible.

Dunn: Can sex crimes ever result in probation in Illinois?

Boardman: Depending on the type of felony that you are charged with. For example, there are Class 2 sexual abuse felonies that are probation eligible. There are Class 4 grooming charges that are probation eligible. But once you start getting into aggravated criminal sexual assault, things where there’s allegations of those types of behaviors with minors, then you’re often looking at charges that are not probation eligible require some Department of Corrections commitment time.
