Scott Michael Dunn: Are field sobriety tests required in the state of Illinois?
Joshua Boardman: They are not required to be participated in. Okay. So, whenever you’re the subject of a DUI stop and the officer asks you, “Do you want to participate in the field sobriety testing?” Or, “I’m going to have you step out of the vehicle and participate in this,” or if the officer asks you to submit to a breathalyzer test, you do not have to consent to that. You just need to understand that you will likely be arrested because you refuse those.
