Scott Michael Dunn: Are field sobriety tests reliable in Illinois? For marijuana use of course.
Joshua Boardman: For marijuana use, they can still try to glean circumstantial evidence from field sobriety testing. So, they’re still looking for signs of impairment whether, you know, that’s the inability to walk a straight line or reverse alphabet or number systems or things like that. I don’t know that there’s a yes or no answer to your question, but it can help build a case based on circumstantial evidence.
Dunn: I just wonder if they do it like a comedy routine.
Boardman: Yes, I don’t know. How many open chip bags are in your passenger seat?
Dunn: How much are they laughing? They’re probably on marijuana.
