Scott Michael Dunn: What if a weapon was involved in a sexual crime allegation in Illinois?
Joshua Boardman: Yes, so whenever a weapon is involved, whether it be an allegation or sexual assault, whether it be an allegation of sexual abuse, it will act as an enhancer. And what that means is basically that the state’s attorney then has the discretion and has the opportunity to file those charges as aggravated, which are then going to come with greater penalties and greater potential prison sentences. They’re going to render those charges as non-probation eligible. So, that having a weapon involved or an injury involved or something, it opens the door, unlocks a greater range of charging statutes.
