Scott Michael Dunn: Will a DUI show up on background checks in Illinois?

Joshua Boardman: It certainly can. Yes. Currently, under the present iteration of Illinois law, there is not an expungement statute or expungement eligibility for a DUI conviction. So, if you were convicted of a DUI, you can expect that it is part of your criminal record and it’ll pop up on a background check. Where you are not convicted through a mechanism called court supervision, where basically you’re placed on a probationary term of months with a court. If you successfully complete that, then that case can be dismissed and it’s a non-conviction. But even then, certain background searches, and especially federal, you can see those arrest records.
