Scott Michael Dunn: What is an aggravated DUI under Illinois law?
Joshua Boardman: Under the Illinois statutes, aggravated DUIs are enhanced essentially. There are different circumstances that can bring them within the purview of aggravated. For example, were you pulled over and charged with driving under the influence with someone under the age of 16 in the vehicle? Would this be your third or greater DUI? Was there an accident or injury associated with the DUI ticket? So, under the statute, there’s several clarifications. Basically, it’s behavior beyond just driving under the influence.
