Scott Michael Dunn: How long can the police detain me during a traffic stop in the Chicago, Illinois area?
Joshua Boardman: For a reasonable amount of time. (Laughs.) There’s not a black letter law, but in order for them to effectuate the questions that they have, the testing that they anticipate doing, I mean, they can’t unnecessarily delay you to try to cook up or generate facts or statements to support their efforts to charge you or write a ticket for a DWI.
Dunn: Sounds conditional and unconditional at about the same time.
Boardman: Yes. So, they cannot weigh you with the motivation of trying to generate a case.
