Joshua Boardman: Yes, because the operative fact is whether or not you were arrested for and subsequently charged with a DUI. So, as a CDL holder, people often think that, “well, I didn’t get a DUI in my commercial vehicle.” But your accountability to the licensing requirements to hold a CDL, those go beyond whether or not you’re operating a commercial vehicle. Those can be if you’re operating your personal vehicle as well.

Dunn: It seems like they’d want to take into account any vehicle operated at any point in time.

Boardman: Yes, it’s not a question of the vehicle, it’s a question of the individual.
