Joshua Boardman: They sure can because it’s not necessarily the consideration of whether or not the defendant was utilizing marijuana, but it’s more an analysis of was that utilization causing impairment. So, a medical marijuana card holder can operate a motor vehicle in an impaired state just like a non-card holder can.
