Joshua Boardman: They can. They’ll be required to rely on circumstantial evidence in order for that case to stick. Essentially, circumstantial evidence can be, did they view open containers in your vehicle? Circumstantial evidence can be, what was your driving patterns leading up to the stop? Circumstantial evidence can be the smell of alcohol on your breath. So even if they don’t have a breathalyzer test or a blood draw, they can still try to prove that case through circumstantial evidence.
