Scott Michael Dunn: Can I be charged with DUI if I wasn’t actually driving in say, Chicago?
Joshua Boardman: You can. And we do get a lot of calls on this. Kind of a comical one that we will get is someone was asleep in a parking lot but they were behind the wheel and they were able to exercise dominion or control or they had the ability to, from that vantage point, drive the vehicle or operate the vehicle. And so they may say, “Well, I wasn’t actually physically driving.” But, based on circumstantial evidence, law enforcement can still write you a ticket for a DUI. So don’t fall asleep in a parking lot.
Dunn: Just get in the passenger seat.
Boardman: Yes, just get in the passenger seat. Throw your keys out the window.
