Scott Michael Dunn: Can DUI probation include alcohol treatment or even counseling in Illinois?
Joshua Boardman: It sure can. And it’s the state’s position and it’s the judge’s position that conditions, they’re not really scare tactics. What they want to do is address any underlying issues that defendant might be facing. Oftentimes, you hear programs like Mothers Against Drunk Driving and sometimes those things are required, but a lot of times it’s their efforts to get to the root cause of maybe someone does struggle with substance abuse issues or alcohol. And so they often times impose those types of conditions to hopefully address maybe some underlying things that could be occurring with that defendant.
