Interview Transcript

Scott Michael Dunn: Can DCFS take my kids because of allegations?

Joshua Boardman: They can. Yes. Now, it is a process. It’s based on a different statutory scheme in Illinois that’s different than the ultimate charging. So, there are certainly things where an incident or an individual will be hotlined and then that hotline may come back as unfounded. And the state’s attorney may, and I’ve had that before where the state’s attorney has investigated deeper and has ultimately filed charges. I’ve also had instances where the state’s attorney’s office has not picked up criminal charges, but DCFS or child protective services still based on their analysis and their statutory factors that they have to follow deemed the child to be at risk. So, they are independent operators.

Dunn: Ah. But all, obviously, working with the same goal in mind, right?

Boardman: Correct. Yes. Protect the child.
