Scott Michael Dunn: What happens to my record if charges are dismissed?
Joshua Boardman: If charges are dismissed, then it does potentially unlock an opportunity to expunge or seal the arrest records. That would at least be a difference between a conviction and a dismissal. Illinois does not allow for processes to be in place to try to remove the arrest records because if a case is dismissed against you, then chances are for whatever reason that was not strong enough to be pursued or prosecuted. So, that is why the restrictions are less when someone wants to expunge or seal their arrest records.
