579.040. Unlawful distribution, delivery, or sale of drug paraphernalia — penalties.

Selling or giving away drug tools is illegal

This law makes it a crime to sell or give away items used to make, use, or hide illegal drugs—commonly called “drug paraphernalia.”

1. You commit this offense if you:

  • Distribute, deliver, sell, or possess with the intent to do so, any item knowing—or when you reasonably should know—it will be used to:
    • Grow, make, or prepare drugs;
    • Test, store, or hide drugs;
    • Inject, swallow, inhale, or otherwise use a drug;
    • Use an imitation controlled substance in similar ways.
