579.040. Unlawful distribution, delivery, or sale of drug paraphernalia — penalties.
Selling or giving away drug tools is illegal
This law makes it a crime to sell or give away items used to make, use, or hide illegal drugs—commonly called “drug paraphernalia.”
1. You commit this offense if you:
- Distribute, deliver, sell, or possess with the intent to do so, any item knowing—or when you reasonably should know—it will be used to:
- Grow, make, or prepare drugs;
- Test, store, or hide drugs;
- Inject, swallow, inhale, or otherwise use a drug;
- Use an imitation controlled substance in similar ways.
2. Penalties:
- It is a Class A misdemeanor by default;
- It becomes a Class E felony if done for commercial purposes (i.e., selling for profit).
