§ 559.100 – Missouri Circuit Court Probation, Revocation & Restitution Rules

559.100. Circuit courts, power to place on probation or parole — revocation — conditions — restitution.

Judges can put people on probation, set rules, and require them to pay victims back.

Circuit courts can give probation or parole to people they sentence, set rules to follow, and make them pay restitution. They can also take probation away if the person violates their probation.

1. Circuit courts can place someone on probation or parole unless it’s a crime specifically excluded by law, like murder or certain sex crimes.

2. Courts can:

  • Revoke probation or parole and send someone to prison.
  • Set rules to help someone successfully finish probation or parole.
  • Require restitution (money paid to the victim).
  • Revoke probation or parole if restitution isn’t paid or rules are broken.
  • Choose to count time on probation or parole toward a sentence.

3. Restitution must be paid through the prosecutor’s office, which may hire others to collect it. The court can add interest and extra fees:

  • $25 fee if under $100 restitution
  • $50 fee if $100–$249.99 restitution
  • 10% fee (max $75) if restitution is $250 or more

These fees go into a fund called the “Administrative Handling Cost Fund.”

4. This fund can be used by the prosecutor’s office for things like office supplies, training, equipment, trial prep, and salaries.

5. The fund can be audited by the state auditor or another agency.

6. Any leftover money stays in the fund and can be used the next year.

7. Victims can still sue the person separately to get their money back.
