304.009. Speed limit — violation, penalty.

Small speeding tickets don’t add points to your license

If you’re caught driving just a little over the speed limit—by five miles per hour or less—it’s treated as a minor offense with no license points.

1. If you drive over the speed limit by 5 mph or less (even though it breaks §304.010), it’s only an infraction. You’ll still pay the same court costs as you would under §304.010.

2. You won’t get any points on your license for going 5 mph or less over the limit.

3. Even though it’s just an infraction, the court can still issue a warrant if you don’t show up in court when required.
