Scott Michael Dunn: Will I be held in jail until trial for a sex crime in Illinois?

Joshua Boardman: If the judge determines that you present a flight risk then yes, you can be held in jail all the way up through your trial date. If the judge determines that you are a threat to the community or you’re a threat to a specific type of person or jus a person in general. I’ve had that where there may be just one isolated alleged victim and there’s really no allegations of anyone else but the judge still chooses to detain based on allegations against that one person because the judge may feel that whatever behaviors towards that one person could translate to other people within the community. So, to answer your question, yes for serious felony classifications like Class X felonies, Class 1 felonies, it is not uncommon for judges to hold someone in custody until the day of their trial.
