Scott Michael Dunn: What conditions can a judge impose on an Illinois sex crime case?

Joshua Boardman: They can get pretty creative. For example, I’ve got cases right now where allegations pertain to a lot of online usage, but only online usage. So, the judge in those cases let them obviously go on pretrial release terms, but those release terms are you’re not able to access the internet, or you have to turn in your cellphone to whomever, any you have to go get a flip phone, and things like that. So, judges have a broad amount of discretion of conditions that they can impose that they feel are curated towards the allegations.

Christopher Combs: GPS monitors?

Broadman: GPS monitoring, curfews. I have had judges essentially say that client-facing individuals that may be like traveling salesmen or whatever are not permitted to continue in that occupation because there may be exposure to minors or something like that. So, I’ve had judges … I don’t want to say that the answer is endless, but there are many creative things that judges can do to put conditions on pretrial release.

Dunn: It sounds like it’s based predominantly on the severity.

Boardman: It’s based on the severity, it’s based on the conduct, and it’s based on what the judge thinks that they can impose to curtail any continued behaviors that they would have a problem with prior to trial.
