Scott Michael Dunn: What is predatory criminal sexual assault in Illinois?
Joshua Boardman: Predatory criminal sexual assault is you’ve got the sexual assault allegations which would be unwanted sexual penetration with the alleged victim. Predatory though is going to be available to the state’s attorney where the allegations are that the defendant was at least five years older than the alleged victim who was underage. Or there’s a classification also where they’re under the age of 13. So there’s going to be five years older so where the ages are between 13 and 17 then there’s also statutory qualifications if they’re under the age of that 13-year-old threshold.
