Scott Michael Dunn: What is aggravated criminal sexual assault in Illinois?
Joshua Boardman: So, not only is there going to be an allegation of some sort of sexual conduct either through penetration or something along those lines, but there’s going to be allegations of conduct oftentimes to give rise to aggravated circumstances. You’ve got the use of a weapon or the threat of a weapon, the alleged victim can be someone that has a disability, some form of handicapped, there are age classifications or is the alleged victim over the age of 60? Was there bodily injury as a result of the actions? If those allegations are tied in with the no-consent and penetration, things like that, then those can enhance the charge that the state’s attorney has available to them.
