Scott Michael Dunn: What happens after a DUI arrest in Illinois?
Joshua Boardman: So, after you get arrested, chances are they’ll take you into their local precinct or police station or wherever it was that you got your ticket and subsequently placed under arrest. At which point in time they will, if it’s just a misdemeanor, a lot of times they’ll fingerprint you, book you, release you. On other styles of cases, maybe if it qualifies as a felony case, they can under the Safety Act in Illinois, hold you for up to 48 hours. And the purpose of that is to determine whether or not the charges are going to be filed and then also it gives the opportunity to the State’s attorney to file a petition to detain that defendant pre-trial. So, if it’s a misdemeanor DWI, chances are after the arrest, they’re going to do what we call book and release.
Dunn: So just get you printed and get you out.
Boardman: Correct.
