Joshua Boardman: As long as there’s not any aggravating factors, it is still a misdemeanor. The difference is there’s an imposition of a mandatory five days in jail, or you can argue for community service. But one of the key differences is that a second-time DUI is coupled with a mandatory requirement for some time in jail.
