Scott Michael Dunn: How long does a DUI stay on my criminal record in Illinois?
Joshua Boardman: It stays on your record indefinitely. A DUI is not eligible for expungement in the state of Illinois. So, it will be on your record, that conviction. Recall that there are options available to a judge at sentencing where there may not be a conviction on your record. Now, could arrest records potentially show up on some levels of background searches? Sure. But, if you are not convicted through some sort of deferred prosecution or court supervision, then there is nothing on your record. But once you do get convicted, you really do not have an avenue of expungement in the state of Illinois.
