Scott Michael Dunn: In Illinois, does refusing the blood or breath test affect a CDL differently?
Joshua Boardman: Your CDL is going to be impacted by an arrest. If you refuse to participate in either breathalyzer testing or field sobriety testing, then under implied consent style laws, then you are subject to being arrested because you refuse that testing. It’s cyclical. The two are hand-in-hand. Where you refuse as a CDL holder or non-CDL holder, where you refuse testing that’s being requested, you’re arrested. So, it’s that arrest that is the trigger point for your CDL.
