Scott Michael Dunn: Do I have to perform field sobriety tests in Illinois?
Joshua Boardman: No, you don’t. You need to understand though that if the officer asks you to submit a blood alcohol content breathalyzer test and you refuse or if the officer asks you to participate in field sobriety testing and you refuse, then you can be arrested at that point. It’s essentially an implied consent as an operator of a vehicle that if you refuse those, then they will take you and I mean they can take you into custody, arrest you. Also, there’s implications on your driver’s license. It’s a difference between revocation of your license versus a suspension of your license. But, you do not have to participate. In fact, if you don’t participate in their requests, you’re not giving them anything to use against you later on.
