Scott Michael Dunn: Do I have to answer questions in a DUI stop in Illinois?

Joshua Boardman: You don’t. My advice generally when clients call and ask about this and ask that question, because that’s one of the biggest questions is what do I say? What do I do? I always tell them freely answer pedigree information, meaning your name, the status of your license, if you are a valid license holder, provide insurance information, maybe your address. But, beyond that, they are going to be asking you questions that you may deem to be innocent. For example, where have you been tonight? What are you to up to? It’s a great night out here, where are we headed? Those types of things. They may seem like innocent questions, but a lot of times it’s the officer searching for circumstantial evidence that would allow them to then ask questions regarding potential impairment or under operating the vehicle under the influence. So, long answer is that. Short answer is you’re not required to answer questions.
