Scott Michael Dunn: Can the police search my car in a DUI stop in Illinois?
Joshua Boardman: There needs to be probable cause. And that can be gained through answers that you as the subject of the stop give to the law enforcement officer. Probable cause can be gained through what’s called open and obvious. Is there contraband? Are there open containers? Is there something in the vehicle that would demonstrate that the law is being broken by driving your vehicle under the influence? Also, they can search your car with consent and oftentimes they’ll try that first. So, yes, they can search the car through probable cause or consent.
