720 ILCS 5/16-28 – Delivery Container Theft
This law makes it illegal to steal, sell, damage, or use marked delivery containers that belong to someone else without permission.
This law says that people can’t take, use, sell, or damage delivery containers that belong to others if those containers have a company name or mark on them. It also explains that truck drivers must have proper paperwork for these containers, and how breaking this law can lead to fines and criminal charges.
(a) A person commits delivery container theft if they knowingly do any of the following:
- Use a marked delivery container that belongs to someone else for any reason when not on the owner’s property or nearby parking area, unless the owner says it’s okay.
- Sell or try to sell a marked delivery container that belongs to someone else, unless the owner gives permission.
- Damage, cover, remove, or hide the name or mark on someone else’s delivery container without written permission from the owner.
- Take a marked delivery container from a business, parking area, or delivery truck without permission. If a person has one of these containers outside the owner’s property and doesn’t have permission, it can be assumed they took it without consent.
(b) A carrier company or delivery driver who picks up or transports delivery containers with a name or mark, but doesn’t have an invoice or shipping paper for them (unless they’re moving bakery or dairy products), is also breaking this law.
(c) Sentence: Delivery container theft is a Class B misdemeanor. The fine is $150 for the first offense and $500 for later offenses.
