720 ILCS 570/405.2 – Streetgang Criminal Drug Conspiracy

This law punishes people who lead or organize drug crimes that help a street gang.

This Illinois law says that anyone who works with others in a street gang to sell or make drugs can face very serious prison time and big fines, especially if they act as a leader or organizer of the group.

(a) A person commits this crime when they take part in a street gang’s drug plan. Anyone found guilty faces a Class X felony with prison time and fines as follows:

  1. Sentence: 15 to 60 years in prison if the drug crime is under subsection (a) of Section 401.
  2. Sentence: 10 to 30 years in prison if the drug crime is under subsection (c) of Section 401.

Someone takes part in this crime when all of the following are true:

  1. They break one of the laws that ban making or selling illegal drugs or meth.
  2. They do it together with at least two other people.
  3. The group’s actions help or support a street gang’s activities.
  4. They are a leader, boss, or manager in this group effort.

The maximum fine for this offense is $500,000, and the person can lose property or money linked to the crime as described below.

(b) Anyone convicted under this law must give up (forfeit) to the State of Illinois:

  1. All money or profits they made from the gang drug crime.
  2. Any property, money, or rights they have that come from or help control the crime operation.

(c) The court can issue orders or take actions, like freezing property or requiring bonds, to make sure the forfeiture and punishment happen properly.
