720 ILCS 550/9 – Calculated Criminal Cannabis Conspiracy
This law makes it a serious crime to plan and join with others to make money by breaking marijuana laws.
If someone teams up with others to make or sell marijuana illegally and earns more than $500, they can face big fines, lose their property, and go to prison. The penalties get worse if they’ve done it before.
(a) Sentence: A person who takes part in a planned criminal cannabis scheme is guilty of a Class 3 felony. They can be fined up to $200,000 and lose any profits or property linked to the crime. If they have any past convictions for marijuana or other drug crimes, the charge becomes a Class 1 felony, which is even more serious.
(b) A “calculated criminal cannabis conspiracy” means a person:
- Breaks othermarijuana laws, and
- Works together with two or more people as part of a plan or conspiracy, and
- Gets more than $500 in value from, or helps organize, direct, or fund the plan or crime.
(c) Anyone found guilty under this law must give up the following to the State of Illinois:
- Any money or profits made from the plan or crime.
- Any property, interests, or rights that came from or were used to control the operation.
(d) The court can issue orders or take other actions to stop the use or hiding of property tied to the crime. This can include things like freezing assets, setting limits, or accepting performance bonds to make sure the property isn’t misused.
