720 ILCS 550/5 – Manufacture or Delivery of Cannabis
This law makes it illegal to make, sell, or have cannabis with plans to sell it, unless the law says otherwise.
This Illinois law says that people cannot grow, make, or sell cannabis without permission. The more cannabis someone has, the more serious the punishment can be–from a small misdemeanor to a major felony with large fines.
Section 5. It is against the law for anyone to grow, make, or deliver cannabis, or to have cannabis with plans to do those things, unless allowed by either the Cannabis Regulation and Tax Act or the Industrial Hemp Act.
(a) Sentence: Having or making not more than 2.5 grams of cannabis is a Class B misdemeanor.
(b) Sentence: Having or making more than 2.5 grams but not more than 10 grams of cannabis is a Class A misdemeanor.
(c) Sentence: Having or making more than 10 grams but not more than 30 grams of cannabis is a Class 4 felony.
(d) Sentence: Having or making more than 30 grams but not more than 500 grams of cannabis is a Class 3 felony, and the fine can be up to $50,000.
(e) Sentence: Having or making more than 500 grams but not more than 2,000 grams of cannabis is a Class 2 felony, and the fine can be up to $100,000.
(f) Sentence: Having or making more than 2,000 grams but not more than 5,000 grams of cannabis is a Class 1 felony, and the fine can be up to $150,000.
(g) Sentence: Having or making more than 5,000 grams of cannabis is a Class X felony, and the fine can be up to $200,000.
