18 U.S.C. § 2421 – Transportation for illegal sexual activity (Mann Act – transportation for prostitution or other criminal sexual activity)
This statute makes it a federal crime to transport someone across state lines for prostitution or other illegal sexual activity.
Section 2421, commonly known as the Mann Act, applies when a person knowingly transports another individual across state lines or international borders for the purpose of engaging in prostitution or other criminal sexual conduct.
What the law prohibits.
A person violates this statute if they knowingly:
- Transport another person across state or national boundaries with the intent that the person engage in prostitution.
- Transport someone for any sexual activity that is illegal under federal or state law.
The government does not need to prove that the sexual activity actually occurred. Intent to facilitate illegal sexual conduct is enough.
Penalties.
A conviction under § 2421 can result in:
- up to 10 years in federal prison,
- fines, and
- additional penalties if minors or coercion are involved under related statutes.
