18 U.S.C. § 496 – Forgery or Alteration of Customs Documents
This law makes it a federal crime to forge or use falsified documents connected to customs and import duties.
This statute applies to documents made or required in connection with importing goods into the United States, withdrawing imports, or assessing and collecting customs duties. It covers both falsifying those records and knowingly using them.
The focus is on protecting the integrity of customs processes and revenue collection.
What the law prohibits.
A person violates this statute if they knowingly:
- Forge, counterfeit, or falsely alter customs-related documents
- Alter writings required for import entry, withdrawal, or duty collection
- Use or submit a forged or altered customs document knowing it is false
Penalties.
A conviction under this statute can result in a fine, up to 3 years in federal prison, or both.
