18 U.S.C. § 471 – Counterfeiting U.S. Currency or Government Obligations

This law makes it a federal crime to counterfeit U.S. money or certain government-issued securities.

This statute targets the creation or alteration of U.S. currency and official financial instruments issued by the federal government. These cases often arise from alleged counterfeit bills, altered notes, or fake government obligations that move through interstate commerce or the financial system.

The government does not have to prove that counterfeit money was successfully circulated. The focus is on the act of making or altering the currency itself, along with the intent behind it.

What the law prohibits.
A person violates this statute if they knowingly:

  • Falsely make or counterfeit U.S. currency or coins
  • Alter genuine U.S. money to appear as a different denomination or value
  • Create counterfeit U.S. obligations or securities, such as Treasury notes or bonds
  • Do any of the above with intent to defraud

Intent matters. Accidental involvement, lack of knowledge, or the absence of any intent to defraud can become central issues in defending these charges.

Penalties.
A conviction under this statute can carry up to 20 years in federal prison, along with substantial fines. Sentencing can increase if the conduct involves large quantities, organized activity, or repeat offenses.

Attempts or related conduct.
Even incomplete or interrupted counterfeiting activity may lead to federal charges if prosecutors believe the defendant acted with intent to defraud.
