Scott Michael Dunn: What happens if I’m arrested for a sex crime in Illinois?
Christopher Combs: Call an attorney.
Joshua Boardman: Yes, first thing. So, what they’ll do is obviously they’ll arrest you, they’ll take you in to the local precinct or sheriff’s department or whomever is doing the investigation. They will do their initial booking process. They’ve got your fingerprinting and all of that. But also at that point in time, they may try to interrogate you, they may try to investigate the claims further, see if you’ll admit to anything. But in Illinois after you’re arrested, then you are going to be placed in custody for at least a period of 48 hours, 24 to 48 hours kind of and some of that depends on the court scheduling as well, but for your detention hearing as to whether or not the state’s attorney is going to file charges within that time, not file charges within that frame. If they do file charges, are they seeking to have you detained prior to trial? All of those things can occur shortly after being arrested.
