Scott Michael Dunn: Let’s talk about the Illinois court process. What happens after I’m accused of a sex crime in Illinois?
Joshua Boardman: After you were accused or after you’ve been arrested?
Dunn: After the charges are actually filed.
Boardman: After charges. So, if charges have actually been filed, it means that the statements, or whatever evidence that law enforcement was able to collect incident to their search, has been handed over to a state’s attorney or assistant state’s attorney. And they are now filing a sex crime based off of those allegations or that evidence. So, once those charges have been filed, it is likely that you will be detained at that point. If you were arrested, then you’ll be detained or a warrant will issue for your arrest and then you’re subsequently detained. The clock starts ticking once you’re detained for a pretrial detention hearing. And so, you’re being advised of what you’re being charged with. Also, you have an opportunity to have an attorney argue at a detention hearing. The sole purpose of that detention hearing is to determine whether you are released prior to your scheduled trial or whether you’re going to remain in custody before trial.
