720 ILCS 5/17-2(d) – Unlawful Use of False Law Enforcement Badges

This law makes it illegal to make police badges without proper permission.

This Illinois law says that it is illegal to make, sell, or give away police badges without written permission from the organization, or if it no longer exists, the organization that took its place. It also outlines some exceptions, such as for acting, where it is legal to make fake police badges. Finally, it sets the penalty for violating this law.

(d) False law enforcement badges.

  1. Making, selling, or distributing fake police badges without written consent is illegal.
  2. It’s okay if the badges are only used:
    1. As a part of a collection, exhibit, or souvenier,
    2. Strictly for decoration, or
    3. For plays, TV, or movies.

(f) Sentence: Violating subsection (d) is a Class A misdemeanor. Doing so again is a Class 3 felony.
