Our client was accused of beating her husband’s paramour and attempting to cause serious physical injury. The alleged victim reported injuries of gashes to her face and an injury to her neck. The assault was caught on video.
5 business days prior to trial, the State offered us 1 year SIS bench probation to assault 4th degree. The offer was based on our investigation that this was clearly a moment of self-defense where maybe our client went a little far with her responsive punches. The alleged victim’s injuries were also clearly dishonestly inflated.
Our client also had immigration concerts, and this result was necessary for her to avoid deportation or suffer negative consequences federally.
