566.116. Sexual conduct with a nursing facility resident or a vulnerable person, second degree, penalty.
Care staff can’t touch residents in a sexual way.
This law says it’s a crime for nursing home or mental health workers to have any kind of sexual contact with people they care for. It doesn’t matter if the person says yes.
1. A person breaks this law if they:
- (1) Work at a skilled nursing facility or Alzheimer’s care unit and have sexual contact with a resident; or
- (2) Work for a mental health program and have sexual contact with a vulnerable person.
2. A first offense is a class B misdemeanor. A second or later offense is a class A misdemeanor.
3. This law does not apply to spouses.
4. Consent is not a valid defense.
